Qualifying for Benefits in Virginia

For Richmond workers, compensation claims are governed by Title 65.2 of the Code of Virginia, as well as the Federal Employees' Compensation Act (FECA). Under these statutes, workers may make a claim against their employer, in lieu of a personal injury action, so long as they meet the definition of “employee” as found in Section 65.2-101. Of course, the Virginia statute may expand the federal definition of employee, but cannot limit the federal rules. Covered employees include any of the following:

  • Any person working for another under any contract of hire or apprenticeship. This definition includes minors and aliens
  • Any apprentice, trainee or re-trainee receiving training related to employee, even if the training takes place outside of normal working hours
  • Members of the Virginia National Guard and the Virginia Naval Militia
  • State employees (subject to exception)
